Insurance policies for athletes, actors, musicians, etc., isn’t new:
In 2015, the NFL filed a lawsuit against 32 insurance companies, claiming that they refused to cover the costs of settling concussion-related lawsuits filed by former players. The league claimed that the insurers breached their contracts and engaged in bad faith by refusing to pay out claims.
The insurers countered that the NFL knew about the risks of head injuries for decades and failed to disclose them to the insurers.
The case was settled in 2018, with the insurers agreeing to pay $790 million to the NFL.
The NFL no longer has general liability insurance covering head trauma, and just one carrier is willing to provide workers’ compensation coverage for NFL teams.
Some insurance industry executives compare the issue to asbestos, an occupational hazard that has cost insurers at least $100 billion.
